Se ordenó al Tribunal Superior de Bogotá que asuma de forma inmediata el conocimiento de la tutela de la referencia, toda vez que esta Corte explicó que al ser remitido el expediente al citado Tribunal, éste debió asumir el conocimiento de la demanda, por cuanto el Fiscal General de la Nación es una autoridad pública del orden nacional.
Si el peticionario puso en funcionamiento la jurisdicción ordinaria, no podía el Tribunal Superior, argumentando que los hechos narrados eran de carácter puramente administrativo, remitir el asunto a otra jurisdicción, pues la competencia no está atribuida, para estos eventos, en virtud de los hechos sino de la naturaleza del demandado.
